Terms of Service

Effective as of June 25, 2026. This document governs access to and use of the Nexus System student project Cloud platform.

Important Information Note — Student Project

Nexus System is currently a student project for educational and experimental purposes. It is not a commercial enterprise, and no legal entity is established. Services and the platform are offered entirely free of charge and without any service guarantee.

# Preamble

These Terms of Service (hereinafter "TOS") govern access to and use of the Nexus System Cloud platform (hereinafter "the Platform"), published and developed as part of the Nexus System student project, as well as all associated features allowing the collection, aggregation, and provision of data from connected Nexus System equipment.

By accessing the Platform or activating the Nexus System client application, the User acknowledges having read, understood, and unreservedly accepted these TOS. If the User does not accept these terms, they must refrain from using the Platform.

01 Article 1 – Definitions

For the application of these TOS, the following terms have the meaning indicated below:

  • "Nexus System Cloud" or "the Platform": hosted IT infrastructure allowing the collection, storage, processing, and return of data from all connected Nexus System equipment.
  • "Nexus System Equipment": any physical pool management device (control unit, probe, connected pump, treatment system, etc.) compatible and referenced by the Nexus System project, equipped with an Internet connection.
  • "Nexus System Data": all technical, operational, and environmental data generated by Nexus System equipment and uploaded to the Nexus System Cloud (temperature, pH, chlorine, flow rate, consumption, alarms, statuses, etc.).
  • "User" or "Client": any natural or legal person, owner, or manager of one or more Nexus System equipments, with an active account on the Platform.
  • "Client Application": the mobile and/or web application made available to the User to view and interact with the data from their Nexus System equipment.
  • "Account": the User's secure personal space, accessible via identifier and password, allowing access to the Platform's services.
  • "Services": all features offered within the Nexus System Cloud, including data collection, real-time visualization, alerts, reports, and history.

02 Article 2 – Purpose of the Platform

The Nexus System Cloud is a cloud services infrastructure intended for the centralization and valuation of data from all Nexus System equipment deployed at customer sites. The Platform provides the following functions:

2.1 Automated data collection

Each registered Nexus System equipment continuously or at regular intervals transmits its operational data to the Nexus System Cloud via a secure connection. This collection is automatic as soon as the equipment is connected to the Internet and associated with the User's account.

2.2 Aggregation and processing

The collected data is aggregated, normalized, and processed by Nexus System servers to be usable in the Client Application. Automated analysis (anomaly detection, trend calculation, predictive alerts) can be applied.

2.3 Provision on the Client Application

Processed data is returned to the User via the Client Application, in the form of dashboards, graphs, history, and notifications. The User can thus monitor their Nexus System equipment remotely, in real time or delayed.

03 Article 3 – Access to the Platform and account creation

3.1 Access conditions

Access to the Nexus System Cloud is reserved for Users who have at least one compatible, registered, and activated Nexus System equipment. The User must be of legal age and have the legal capacity to enter into a contract.

3.2 Account creation

Creating an Account is mandatory to access the Services. The User agrees to provide accurate, complete, and up-to-date information upon registration. They are solely responsible for the truthfulness of the information provided.

3.3 Identifiers and security

The User is entirely responsible for the confidentiality of their login credentials (email address and password). Any use of the Services from their Account is deemed to have been made by the User themselves. In the event of suspected compromise, the User must immediately inform the Nexus System team and change their credentials.

3.4 Equipment association

The User associates their Nexus System equipment with their Account via the Client Application or web portal, following the pairing procedure defined by Nexus System. Each piece of equipment can only be associated with one active Account at a time.

04 Article 4 – Description of Nexus System Cloud services

The platform offers the User several features for monitoring and controlling their equipment:

  • 4.1 Real-time supervision: The User has a view of the status of their Nexus System equipment (water parameters: pH, chlorine, temperature, ORP, etc.; device status, consumption levels, and reports).
  • 4.2 History and reports: The Platform retains data history for a defined period. The User can generate customized reports and export their data in available formats (PDF, CSV).
  • 4.3 Alerts and notifications: The User can configure automatic alerts (push, email, SMS) triggered when thresholds are exceeded, equipment fails, connectivity is lost, or an anomaly is detected.
  • 4.4 Remote control: Subject to compatibility, the User can send remote commands from the Client Application (modification of setpoints, treatment cycles). The User assumes full responsibility for the commands sent.
  • 4.5 Equipment updates (OTA): The Platform can deploy Over-The-Air (OTA) software updates to associated Nexus System equipment to improve functionality, security, or compatibility.

05 Article 5 – Data collected and processing

5.1 Nature of collected data

The Nexus System Cloud collects the following categories of data:

  • Technical equipment data: hardware identifiers, software versions, diagnostics, connectivity data.
  • Operational data: physico-chemical water measurements (pH, temperature, chlorine...), flow rates, filtration, electrical consumptions.
  • Usage data: Client Application usage statistics, configuration preferences.
  • Identification data: last name, first name, email address provided during account creation.

5.2 Purposes of processing

The collected data is used to provide and improve the Services, provide technical support, generate anonymized improvement statistics, and comply with any regulatory obligations.

5.3 Data sharing

The Nexus System student project does not commercialize User data in any way. Data is only shared with hosts or technical services essential to the platform, in compliance with confidentiality.

5.4 Data security

Technical measures (TLS/SSL encryption of data flows, secure storage) are implemented to protect data against unauthorized access or alteration.

06 Article 6 – Personal data protection (GDPR)

Data processing is operated by the Nexus System project in compliance with the General Data Protection Regulation (GDPR) and French regulations.

6.1 Legal basis

Processing is based on the contractual execution of access to the services requested by the User and on their explicit consent.

6.2 Retention period

Account data is kept for the entire duration of Account activity. Technical pool history data is kept for a period limited to the project's objective (typically 12 to 36 months depending on server technical capabilities).

6.3 User rights

The User has rights of access, rectification, erasure, limitation, and portability of their data. To exercise these rights, the User can send their request by email to the following address: [email protected]. The User also retains the right to contact the CNIL.

07 Article 7 – User Obligations

The User formally agrees to:

  • Use the Platform and Client Application in accordance with these TOS and applicable laws.
  • Not attempt to bypass the security measures of the Platform, nor disrupt or attempt to overload the servers.
  • Ensure network and Internet connectivity of their Nexus System equipment.
  • Provide and maintain a valid email address for their Account.
  • Immediately report any malfunction or security flaw noted to the technical team.
  • Keep their credentials confidential and not give access to unauthorized third parties.

08 Article 8 – Service Availability and Quality

8.1 Availability commitment

As an academic and experimental project, Nexus System strives to keep the platform accessible but does not guarantee any Service Level Agreement (SLA) or any Platform availability rate.

8.2 Maintenance

Maintenance or technical development operations may temporarily interrupt the service at any time. The team will strive to inform users by email or notification beforehand as much as possible.

8.3 Limits

Collection and restoration depend on the User's Internet access. The project declines any responsibility in the event of a third-party network failure or hosting infrastructure failure.

09 Article 9 – Intellectual Property

All components of the Nexus System Cloud platform and Client Application (interfaces, source codes, designs, logos, databases, algorithms, documentation) are the exclusive property of the Nexus System student project and are protected by copyright.

The User benefits from a non-exclusive, revocable, and personal right of use, excluding any commercial or industrial exploitation.

Data generated by the User's equipment remains their property. The User nonetheless grants the Nexus System project the right to use and aggregate this data for analysis, execution of supervision services, and technical improvement.

10 Article 10 – Liability

10.1 Nexus System Liability

The Platform being provided on an experimental, educational, and free basis, the Nexus System project excludes all liability for any direct or indirect damage, data loss, operating loss, or inconvenience related to the operation or malfunctions of the Platform or associated equipment.

10.2 User Liability

The User is solely responsible for their use of the Services and the remote control of their pool equipment. Online supervision cannot replace a rigorous and regular physical check of the installations.

10.3 Force majeure

The project cannot be held responsible for failures resulting from cases of force majeure, large-scale cyber attacks, general Internet network failures, or hosting incidents.

11 Article 11 – Term, termination, and suspension

These TOS apply throughout the User's use of the Platform.

The User may request the deletion of their account and data at any time from their space or by contacting support by email.

As a temporary and academic student project, Nexus System reserves the right to interrupt, suspend, definitively stop the servers and services of the Platform at any time, without notice and without any compensation being claimable by the User.

12 Article 12 – Pricing and billing

Access to the Nexus System Cloud and basic Services is currently entirely free, the project being deployed for purely educational and experimental purposes.

13 Article 13 – Amendments to the TOS

The project team reserves the right to modify these TOS at any time to reflect developments in the Platform or the legal framework. Users will be informed of any significant modifications. Continued use of the services constitutes tacit acceptance of the modifications.

14 Article 14 – General provisions

14.1 Applicable law and jurisdiction

These TOS are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution as a priority. Failing this, the dispute will be submitted to the competent French courts.

14.2 Severability

If any clause of these TOS were held to be null or unenforceable, the other provisions would retain their full validity.
